Samsung drops a patent-infringement counter-suit against Apple

“Samsung Electronics Co. dropped a patent-infringement suit against Apple Inc. (AAPL), filed at a U.S. federal court in April in response to allegations its Galaxy products copied the iPhone and iPad,” Bomi Lim reports for Bloomberg.

“Samsung Electronics dropped the suit on June 30 ‘to streamline the legal proceedings,’ Nam Ki Yung, a spokesman for the Suwon, South Korea-based company, said today in a telephone interview,” Lim reports. “Samsung will continue to defend its patent rights through a counter-claim in an earlier suit Apple filed at the same court in San Jose, California, he said.”

Lim reports, “Litigation between the two companies, which compete in the mobile-device market, is under way in at least five countries including South Korea, Japan, Germany and the U.K. Withdrawal of the California suit won’t affect other U.S. cases or patent- violation complaints Samsung raised against Apple in other countries, Nam said.”

Apple consortium wins $4.5 billion Nortel patent trove auction; Google, Intel lose bidding battle

“A group including Apple and Research In Motion has paid $4.5 billion to snatch Nortel Networks’ patents from under the noses of Google and Intel , stealing a march on their rivals in a litigious market,” Renju Jose and Georgina Prodhan report for Reuters.

MacDailyNews Take: Boom!

“Nortel had put up for sale 6,000 patents and patent applications in the largest public sale of its kind, a potential treasure trove for latecomers to the market such as Apple, Google and Intel,” Jose and Prodhan report. “The price was about three times what the sale had been expected to raise, underlining the defensive value of intellectual property in the fast-changing telecoms world, where established players are seeking to keep out newer rivals.”

Jose and Prodhan report, “The winning parties — the others are Microsoft, EMC, Ericsson and Sony — are expected to share the patents to maximise their scope to pursue patent litigation, though they did not disclose details… Google, the newest major entrant to the mobile market, with its three-year-old Android software platform, has a weak patent portfolio compared with telecoms rivals and will now be more vulnerable to lawsuits from the auction winners.”

Jose and Prodhan report, “The search engine market leader had opened the bidding in April with a $900 million stalking-horse bid, and had been expected to be a winner.”

Jose and Prodhan report, “BlackBerry maker Research in Motion will pay $770 million of the purchase consideration, and Ericsson will pay $340 million. The other parties did not immediately say what their share would be… Richard Windsor, global technology specialist at Nomura Securities [said] ‘And then the consortium will go out and seek to make a return by prosecuting the other people, particularly the Android camp.’”

Apple iPad 3: An October surprise?

“Yes, the iPad 3 is coming. But when? Persistent rumors say as early as this fall, perhaps in conjunction with the launch of Apple’s next-generation iPhone,” Jeff Bertolucci reports PCWorld.

“Whatever its launch date, the iPad 3 is expected to be a humdinger of a tablet with a killer display that puts the iPad 2 to shame,” Bertolucci reports. “A recent report from Taiwan’s Economic Daily claims the next-gen iPad’s resolution will be five to six times higher than that of the iPad 2.”

“If that seems unlikely, a January 2011 report from Digitimes says the iPad 3 will have a screen resolution of 2048 by 1536 pixels — four times that of the iPad 2's 1024 by 768,” Bertolucci reports. “Research firm IDC at the time was hearing similar reports from its sources as well.”

Bertolucci writes, “A fall 2011 debut for the iPad 3 seems premature, however, for several reasons.”

Samsung scoffs at Apple in California lawsuit defense filing

“Late on Thursday, Samsung filed its answer, affirmative defenses and counterclaims to the amended version of Apple’s complaint in Northern California,” Florian Mueller reports for FOSS Patents.

Mueller reports, “Most of the document consists of ‘boilerplate’ and the usual wholesale denial of all allegations, but there are a few interesting things to say about it. In particular, Samsung scoffs at Apple’s attitude toward its competition by (repeatedly) stating the following: ‘The Samsung Defendants admit that they have not ceased competing with Apple notwithstanding Apple’s efforts to avoid such competition.’”

“That’s the obvious position for Samsung to take,” Mueller writes. “While Apple describes Samsung as ‘the copyist,’ Samsung naturally argues that it’s just competing.”

Apple completes OS X Lion, sends GM to developers

“Apple through its developer page sent out the finished, or gold master, build of Mac OS X Lion,” Electronista reports.

“The 11A511 build should be the one to reach the Mac App Store and possibly a wave of new Macs,” Electronista reports. “No mention has been made of when the OS will be made available to the wider public.”

Electronista reports, “When it does ship, it will cost $29 per person and will also be available in volume licenses that depend on redeeming codes. Lion Server will cost an extra $50 as a bolt-on upgrade, again from the Mac App Store.

Apple Releases Mac OS X 10.6.8 Update

Apple has released the Mac OS X 10.6.8 Update via their Software Update Utility and website for direct download. According to the release notes, this update is recommended for all users running Mac OS X Snow Leopard and includes general operating system fixes that enhance the stability, compatibility, and security of your Mac, including fixes that:

  Enhance the Mac App Store to get your Mac ready to upgrade to Mac OS X Lion.

  Resolve an issue that may cause Preview to unexpectedly quit.

  Improve support for IPv6.

  Improve VPN reliability.

  Identify and remove known variants of Mac Defender.

  Corrects timezone data in iCal for Lisbon-Portugal.

  Adds the ability to use Kerberos authentication to a web proxy server.

  Fixes an issue when saving documents from Xcode or TextEdit when using an NFS home directory.

  Fixes an issue when importing certain media files into Final Cut Pro.

  Includes RAW image compatibility for additional digital cameras.

The Mac OS X 10.6.8 Update weighs in at 474.MB and requires Mac OS X 10.6.7. Apple also released a Combo update weighing in at 1.09GB for those of you looking to update from previous versions of Snow Leopard.

Why Apple built Final Cut Pro X

“I worked on Final Cut Pro [at Apple] from 2002 to 2008. It was an amazing experience. The Final Cut Pro X project was just getting started when I left Apple. It was an ambitious and controversial move, but it made sense for Apple,” Sachin Agarwal writes for Sachin’s Posterous.

“The pro market is too small for Apple to care about it. Instead of trying to get hundreds or even thousands of video professionals to buy new Macs, they can nail the pro-sumer market and sell to hundreds of thousands of hobbyists like me,” Agarwal writes. “Millions of people are buying phones and cameras that can shoot HD video, and many of them are looking for ways to edit. I know how to use Final Cut Pro because I worked on it for 6 years, but for most people it’s just too complex.”

After redefining the non-linear editing market, competitors began to compete on Apple’s terms. “It was time to reinvent the video editor. And Final Cut Pro X really delivers there. FCPX isn’t defined by a feature chart,” Agarwal writes. “It’s not trying to do more than its competitors, it’s doing it better. And once again, Final Cut Pro stands on its own. And once again, Final Cut Pro will expand the market of video editors out there, and I’ll be one of them.”

Apple files preliminary injunction in U.S. against Samsung Infuse 4G, Galaxy S 4G, Droid Charge, Galaxy Tab 10.1

“Right before a long weekend in the U.S. (due to Independence Day on Monday), Apple attempts a hole-in-one in its legal spat with Samsung. Apple has filed (with the U.S. District Court for the Northern District of California) a motion for a preliminary injunction,” Florian Mueller reports for FOSS Patents.

“The motion targets the following four Samsung products: Infuse 4G, Galaxy S 4G, Droid Charge, and Galaxy Tab 10.1.,” Mueller reports. “Shooting for a preliminary injunction is a bold gamble for Apple. If Apple’s motion is granted, Samsung will be forced within a matter of a few months — possibly less than two months — to take it flagship Android-based products from the U.S. market. Just the possibility of this happening could lead Samsung to settle with Apple early on. But if Samsung doesn’t cave and Apple’s motion fails, Apple’s position will look weak… It’s important to consider that a court grants a preliminary injunction only if there’s a really strong and convincing case.”

Apple likely to dethrone HP as leading portable PC vendor in 2012

“Apple is likely to replace Hewlett-Packard as the global number one notebook vendor in 2012 if tablet PCs are included in the calculation of global notebook shipments, according to industry sources,” Max Wang and Steve Shen report for DigiTimes.

Along with an estimated 40-60 million iPads, “Apple is also likely to ship 15 million MacBooks in 2012, bringing its combined shipments of notebooks and tablets to a total of 75 million units, accounting for 25-30% of the global notebook market, the sources estimated,” Wang and Shen report. “HP shipped 40 million notebooks in 2010 and is expected to ship 45-50 million units in 2011, noted the sources, adding that HP will not be able to compete with Apple for the tops title in 2012 based on its performance in 2010 and 2011.”
